Image's original artists & writers retained ownership of their individual creations, as part of their original beef with Marvel was over licensing and merchandising. Image got a chunk of any profits, but the ownership went to the creators. When Image re-organized, several of it's writers sold (entirely or in part) their ownership to Image, but McFarlane retained his. If you're inclined to debate me on this, check out the long-running lawsuit over ownership of Medieval Spawn and some other characters created by Neil Gaiman. Image wasn't even named in the suit... Todd McFarlane, and that was because in theory, he owned all of the characters created during his editorial tenure on the book. In one of life's great ironies, McFarlane stormed out of Marvel because they wouldn't let him do what he wanted with villains he created for Spider-Man... and then turned around and did exactly the same thing to Gaiman.

In some sense I can understand his desire to own his creations and he sounds very reasonable when he talks about his opinion that writers and artists should share in the success of their comic. He's not lying when he says that sales were down on Spectacular Spider-Man until he took over, and then the character became very popular again, so maybe he should have been paid based on profits rather than a flat rate or something...
But the flip side of that coin is that when sales are down, how would he have felt about being paid less? 8)
Besides, it's simply obvious that a company must keep ownership of characters related to their licenses. It would make no sense for Venom to suddenly appear in DC comics fighting Batman and then in Arhcie comics a year later because the guy who created him changed jobs.

Because the meme is actually "Batman wins" or "Batman always wins." I would argue that while he's certainly lost individual fights, he's never been properly "defeated." Even being killed doesn't stop him from getting the KO in the third round

Well then no, not really. Heroes get defeated in the third act with surprising frequency, considering that they're theoretically the reason for the existence of the story in the first place 8)
